On applications, why do they ask if you were arrested, convicted, date and outcome if they check anyway?
I really don't get it.
Answers:
If you are dishonest, they can not hire you.
They ask to decide if they want to check into it. They will check into it if it is important. It is a way they can use to determine how truthful you are. And to give you a chance to defend yourself for what occurred if it wasn't recent and you are young.
It's another way to check your honesty.
So they can throw your application away if you were.
It should be illegal to ask until after hired, or until an interview.
Write your congressman.
Probably to check you honesty and competence.
They ask those questions so they will know whether they want to pay for a background check. Also honesty is another big factor.
But if you have a conviction of car theft, then a car dealership will know not to hire you and they will not have to pay for the background check.
Background checks are not cheap so you have to weed out the ones that you will not hire because of their past.
I have done a lot of hiring in the past and I have hired people that have been convicted of felonies, but I was not allowed to ever hire anyone who had committed certain crimes like an armed robbery or a sex crime, to name a few.
If they check anyways, why guess would be to see if you are honest.
By the way, you have to sign something giving them permission to look at your criminal record.
They want to see how honest you will be.
They also want to give you a chance to defend yourself/explain your position.
The first reason has to do with honesty and truth. If you lie on your application how can you be trusted or what might you lie about next? The second reason is that your employer has a right to know what they are up against or getting themselves into by hiring you. It may be an insurance matter, it may be a security matter and it may be many other things as well. Would you expect a bank to hire a person convicted of forgery or grand larceny? The third reason is if they didn't ask you and did a background check on you without permission it may very well constitute a breach of your civil rights. Not every employer does check but in these times they are more apt to.
The positions I apply for require a security clearance and yes, they do check. If you are applying for a position of trust involving handling money or property, patients, personnel records, etc. the employer will want to know that you are trustworthy. The quickest way to lose a job before you get it is to omit an arrest or conviction that they find out about during the back ground check. You can get a job if you are open and up front about any arrests and convictions. It's the ones you don't divulge that they find out about that will determine if you can be trusted.
