Can you still get fired.?
i have a friend who recently got fired from a clothing store. because it was her first job, she was kind of pissed but sad at the same time. the thing is she had asked one of her friends to pirnt out her schedule for her and when her number was terminated, that friend asked the manager why that was. the manager said because she had 3 write ups. but my friend knew only about one of the write ups but never signed it. she had asked her manager about it previously but they never made her sign it. is this right? do the managers have the right to fire someone like that? and the manager never told her that she was fired, my friend had to hear from her friend. what should she do?
Answers:
Refusing to sign a written warning does not negate the warning or protect you from getting fired.
Written warnings generally have to be delivered to the offending employee for them to be used in termination, however, most states are employment "at will" which means the employer can fire you for any reason.
So, if the employer let a co-worker pass the word to your friend that she was fired, that is bad form, but not necessarily illegal.
Look on the bright side, your pal can file for unemployment.
your friend had to be aware of any write ups she had, whether she signed them or not. if you do not sign a write up it doesnt mean that it doesnt count. it just means that you do not agree with it. the manager should have told her that she was fired and not have someone else tell her unless that person was her supervisor. it is also no other employee's business why someone was fired (again unless this employee was her supervisor). your friend can ask to see the other write ups in her file if she has questions. another possibility is that she had done something that caused her to be fired on the spot something like being caught stealing from the company or similar to that. not saying that is what happened but it is a possibility. perhaps your friend is not telling you the whole truth. if she does have 3 write ups she knows about them all. unfortunately, most employment is at-will which means that the employer or the employee can discontinue employment at any time for any reason. the only reason they wouldnt be able to do that is if your friend had a contract. with a clothing store, they can fire at any time for any reason or no reason at all.
