In NYS, is it a law that employees must take a meal break?

Would an employer in NYS be violating any labor laws if an employee voluntarily works through meal break period so they could get overtime pay or comp time? For example, if an employee forgoes lunch break, to earn an hour of extra pay and/or an hour of extra time off each day, would the employer be violating any laws?

Answers:
Not if you and your boss both agree to do it voluntarily.

But if you want to work 8 hours "non-stop". after lunch you might need to punch at least 15 minutes or the computer will keep running "overtime" for the rest of the day, and most companies can fire you and your supervisror for that.

Usually this could work better if your boss is the owner of the place and is made clear that it will be only overtime for the lunch hour and not for the rest of the regular hours.
