Can we sue tesco?
My mother slipped and fell on a wet patch of floor in our local Tesco. The wet patch was not signed. An employee had just mopped the floor.
She has broken her foot and will be unable to go into work for 6 weeks as she cannot drive.
Can she sue Tesco?

I work at a hospital. There was an artsy fartsy access bridge from the footpath to the library... It had been raining the night before and as the brige was made of wood was really damp... However.. I didnt realise it was like an ice skating ring and really hurt myself...
The library manager ran out as soon as it happened and said, she knew it was gonna happen as it had been reported before and she herself had slipped the day before..
Anyway...had the injury had been less I may not had bothered..But i was in agony, had an operation, physio and walk on crtuches for 26 weeks, this all happened the day after I moved into my first home...So had to move straight back cos I could look after myself as in mastering the stairs, driving...
Anyway, contacted some no-win -no -fee place..They line you up with a local solicitor...Hospital admitted liability immediately...But the accident happened in Oct 03.. I got the money June 05... So its not a get rich quick thing...
A broken foot is a big thing really, for someones negligance...The cleaner will inevitably loose her/his job, so maybe you could contact tesco directly and ask for an out of court resolution...Through maybe Citizens advice bureau...
But Ive done it... My problem was i settled to fast..based on the operation, time off work, inconvenience, physio.just the things that had happend up to that point.I now at age 25 have arthritis as a result in my knee...But you cant reclaim... If your mums up to the hassel..Go for it...

As a customer, Tesco owes you a duty of care. Spillages must be clearly sign posted and, if not, it can result in a claim for negligence when someone slips.
First you need to get in touch with Tesco to report it. that done, you will have to fill in a claim form, and make sure that you get medical reports. The courts like people to try to sort matters out for themselves at first, and to only go to them when you disagree over the figure.

First of all, was the accident witnessed by anyone? If not, there may be problems with proof. Secondly, was the accident entered into the stores Accident Book? If not, there may be legal problems.

Are Tesco's aware of the incident? Hopefully it was reported immediately it happened and was also recorded in their Accident log?

The first thing you must do is make sure Tesco are aware of the incident and the damage done to your mothers foot. It is possible that your mother can come to an arrangement with Tesco without all the trouble of you having to use legal proceedings. However, if Tesco act awkward then your best bet is to contact one of the many 'had an accident, no win no fee' firms.
You can, see a lawyer about it. You will probably get money from Tesco as they cant be bothered with court, or the bad publicity a drawn out court case will cost, so they will probably just hand over some compensation.
Tesco didnt pay this man some money (some insurance thing of theirs or something) and he got in bailiffs to take £4000 worth of alcohol from a Tesco store. If hed wnted to he could have frozen all of Tesco's bank accounts.
