Should 5 non-elected county officials be allowed to make and enforcse laws governing businesses?

Our local county (in WV, USA) health board recently passed a no smoking ordinance, including bars, restaurants and fraternal organizations. These people are appointed, not elected. Is it fair for them to dictate law, and the public not to have reprecussions for their actions if they dictate an unpopular decision? Say, for instance, I'm an appointed board member and I'm allergic to perfumes, and I talk 2 other members into passing a law banning perfumes, Should that be legal?

Answers:
If they are appointed, they are still responsible to the officials who appointed them. If you do not like their decisions, you have the right to complain to those officials and suggest that the current board members be replaced when their terms expire. If those officials reappoint the current board members and the public does not like the board policies, they can take it out on the officials doing the appointing.

My personal preference is that no board should have the power to enact ordinances without being elected. An appointed board should be limited to recommending ordinances or screening requests for changes to ordinances, but should not have the final say on enacting new ordinances.


Yes, it's perfectly legal. Even if they are appointed, they are appointed BY SOMEONE WHO IS ELECTED. So you can always vote their masters out of office and vote in someone who will appoint the people you want.
State government boards are all appointed and even yourself can apply to be on a board of your interest, They also carry the duties of creating policy amongst other things, this is why more people other then elected official friends should apply to be on the board because it's an opportunity for all to get involved with the changes that are made and will affect us.
