Is a contract binding if a 17 year old signs it?

My cell phone company allowed my 17 year old daughter to sign a new two year contract in my name!

1) she's a minor

2) she signed in your name (fraud)


I think she has to be the age of consent, 18, for it to be binding, and being it was in your name, there is no contract
No. Not unless it's for a necessity, which a cell phone isn't.

If she signed your name though what she actually did was commit a fraud against you and the cell phone company, by representing that she was you. If you cancel the contract on that basis, the cell phone company may take her to court for fraud or theft of services.
No, it's not. I think I hear a law suit around the corner. They are allowing her to commit fraud. They aren't even allowed to let you phone them, while shes in their office, for you to give them permission for her to do so.

If the cell phone company knowingly allowed your daughter to sign your name on a contract then they are the ones breaking the law as well...My guess is they'll let you out of the contract after one phone call from a lawyer.
