Can a quit claim deed for a house be signed and notarized at a US embassy?
My dad has a house in California and went to the Philippines before he had his wife sign a quit claim deed to his house. Can it be signed at the US embassy in Manila and then mail it back to California to be recorded to they have to wait until they return to California which will not be for awhile. Will it be legally appropriate?
Answers:
The United States Embassy in Manila, Republic of the Philippines is considered US Territory. The US Embassy has notary services available for American citizens, and the notary there can notarize any document needed.
A quit claim deed need not be notarized in the state where the property is located. So yes, if he or his wife are in the Philippines and need it notarized, the Embassy can handle that for him.
NOTE: They can NOT notarize the document without the person who signed it signing in front of them. No notary should ever do that. However, as long as the person signing the quit-claim deed is there in Manila, there shouldn't be a problem.
