That is a matter of opinion. Growing up we had a house where some weird stuff happened. So I tend to lean towards yes on that one.
But I don't think anyone can really "prove" a house is haunted.

yea. a very long time ago when i was about 8 or 9 i was at my grandparents(R.I.P) house for the night. they both fell asleep. at about 2 in the morning i got up to get a drink of water and go to the bathroom. when i was in the bathroom i heard a strange noise. it was a moaning sound then i heard a knock on the door. i opened it and there was nobody there. then when i got back in my bed i kept hearing this moaning sound. i went into my grand parents room and there was this white smoke all around. (there was no fire and my grandparents did not smoke.) as i was trying to tell my grandpa what happend i felt this tickle on my foot. i looked down and there was dust on my feet. my grandparents let me sleep with them for the rest of the night. its weird. i remember it like it was yesterday. this was over 25 years ago. pretty creepy.
As a matter of law yes. There is a new york court of appeals case that found that a particular house was haunted as a matter of law. Can't recall the exact case name but it was S______ v A________.
There is legal precedent allowing a homeowner to be sued for failing to disclose a house was haunted. (NY case - don't know the citation off hand.)
Some are usually very old houses and some that's near a cemetery.
