If i'm 15 and my boyfriend is 18, can he get in to trouble?
Don't call him a pedophile or tell me to stick to my age because we've been together since i was 12 and he was 16. He ISN'T using me. I'm going to be 15, he is going to be 18. Will he get in to trouble? and if he does, is that only if we have sex? I don't want anything bad happening to him.
(we haven't had sex and he understand that, and he wants to wait too until he thinks he is ready. and im not some little idiot cuz YES HE SAID "i don't think im really ready, and i dont want to unless im 100 percent sure")
I live in california, i know i have to be 18 before sex with him or w/e so please dont tell me again.
Answers:
Intercourse or oral sex are unlawful until you are 18. "Lewd acts" are not unlawful with a 14 year old unless the other person is more than 10 years older. (Penal Code section 288, subd. (c)(1).) As far as I can see, there are no crimes with which your boyfriend could be charged right now so long as you are not having sex. (Of course, underage drinking and things like that could be illegal, but that is not what your question is about.)
HOWEVER, if you were engaging in "lewd conduct," which pretty much means touching for sexual pleasure, when you were under 14, he WAS committing a crime (Penal Code section 288, subd. (a)), and that could still be charged against him. The odds that the matter would be pursued might be low after this period of time, but it is not beyond the realm of possibility.
congrats on your maturity, he can only get in trouble if someone---like your parents press charges. 18 to 15 is illegal in the eyes of the law.
I do not know about California , they change their laws daily out there , one day it is OK to do something ,the next day it is illegal . Here on the east coast , Not a whole lot would be said unless your parents filed a complaint , now keep in mind , if he has alcohol ,cigarettes , etc , it is contributing to the delinquency of a minor , and there can be no kissing in public ,because that would make it a public issue win which the authorities can get involved . When are are 16 you would be in the clear over here , I was in the same situation years ago.I was 20 and she was 15 , and I caught h*ll for that , even though at the time I did not know her age , I am now going on 38 and she is going on 33 and everyday is just as if it were the first day we met , so it can be done , We are proof of that , and despite what California thinks of the south east , My girlfriend is of no relation to me , not even back to the day our families came over on the mayflower. You just have to be careful away from home , if your parents are fine with this , you should be OK , besides California should have better things to worry about than you ,and him . Especially with all of those Hollywood junkies running wild over there , and the self proclaimed child predator who thinks he has freedom of speech out and about stalking children. So I would not worry about it , I wish you two the best of luck , and it can be done with no problems , just do not get mad at him and threaten to call the law to turn him in when he leaves the toilet seat up ...ha ha ha ...
Any 16 year old, who'd date a 12 year old, is a loser. Dump him, and fast.
1. Yes your parents (and because your a minor, the state) can pursue charges regarding the person on a number of grounds outside of statutory rape (consensual sex charges):
a. Driving a vehicle with you inside without their consent
b. Providing you with or performing certain actions with you that are illegal for you. The most clear answer would be underage drinking. Once 18 he is an adult in California so if he commits a crime (like drinking underage, or smoking marijuana) in your presence, this is a crime of itself.
c. Violating curfew laws with you when he is 18.
d. If you break any laws and this is traced to your 18 year old boyfriend, your parents our the DA might try to consider this as contributing towards your delinquency. Acts can include Truancy, Stealing, Drug Use, smoking, Alcohol Use under 21, Vandalism, Gang Involvement, etc.
The applicable laws in CA are: PC 1346-1347.5, PC 12101 , PC 1191-1210.5, PC 7510-7519, PC 701-714, PC 639-653.1, PC 270-273.75, PC 240-248, and PC 484-502.9
Now a bit about sex: California Law PC 261.5 makes is a crime called unlawful sexual intercourse (note, that intercourse, not making out) with any minor who is not the spouse of the perpetrator. This is a misdemeanor if the perpetrator is not more than three years older than the victim. There is no excuse or defense, however, sex after legal marriage is not included in this law. So a 18 year old may have a sexual relatinoship with a spouse who is 15.
Now onto the laws regarding making out with a 14 or 15 year old. An 18 year old who performs lewd or lascivious acts (which can be broadly defined as oral sex, making out, or even speaking of sex with you). PC 288(c)(1) notes that the perpetrator must be at least 10 years older than the victim in order to receive jail time, but I'm not clear if a misdemeanor can occur if there is a 2 or 3 year gap. Also if the perpetrator is a caretaker, regardless of age difference, a stiffer fine can be imposed. And finally is the perpetrator is accused of doing this by intimidating you (this could be interpreted as a lot), then this is even a more serious felony, and age difference does not matter. So in your case, the court would have to purse felony charges and prove that you were coaxed or intimidated (this is not forcing you).
I'll put it a different way, the police will respond to any complaint filed by your parents, or anyone else for that matter. Any complaint regarding a minor such as yourself is investigated more seriously, and depending how this call is filed, often requires an initial arrest be made for certain types of complaints. For example, a complaint about an argument involving you and your boyfriend, say with your father, might trigger a mandatory arrest with the agressor.
I doubt any of these issues will or shoud happen in your relationship with your boy friend. But because you're asking, I suspect you are concerned that for some reason someone may complain.
