Can i really be sued ?

i put out several flat cake pans of warm beer in my front yard to drown some pesty crickets. i read where this works really well, but it backfired. the neighborhood dogs drank the beer and one staggered into the road and caused a accident and another one bit the old man who lives across the street. now everyone has threatened to sue me. can they do this ? i never meant to get the dogs drunk. please help...thanks

Check re the laws about un restrained dogs in your township..

where i live it is illegal to allow your dogs to roam, so depsite you having placed beer in your front yard .. had your neighbour not allowed their dogs to roam ..there would have been no problem ..

who would they have sued IF these things took place without your beer .. and who is to say these things wouldn't have happened anyway ..

THEY are responsible not you ( least in my opinion )


It's possible you can be sued, but it sounds like if you were sued u could win it. Just be prepared
okay technically you could be sued but they have no case because the dogs werent suppose to be on your property to begin with; if the owners would have watched their pets the whole mess wouldnt have happened. I dont think you have anything to worry about

No blood test done(legal blood test) for alcohol in the dogs.no case based on a dog being "drunk"..period. Either way, their dogs, YOUR property. Where were THEY when their dogs were loose?
Unfortunately in a civil case you can be sued for anything. It's just a matter of if you have any assets for a lawyer to latch on to and if there are any laws to support the case against you. If you are not rich, then don't worry to much about it. Your neighbors have no case (unless they have a really slick lawyer) because they are supposed to control their dogs. They should not be roaming free through the neighborhood like a wild pack. I am pretty sure that every community has a leash law.

Keep being nice to your neighbors. Keep explaining your good intentions and the fact that it is your property and you can do what you want. Unless they just hate you and have a lot of money to waste, you should be okay.
Mate I really don't know, but I have allowed myself a little giggle at your expense..but seriously, beer is not an illegal substance and t was on your property. Is it legal for them to allow their dogs to roam the streets and not be fenced in properly. There is fault on both sides here, not just with you. You will have to get some legal advice if they act on their words.
You can be sued for anything. how good a case they have is another issue.

I think the responsible party is the owner of the dogs that should not have been loose.
If they try, you can cite leash laws when you go to court. Their dogs had no business being on your property, or roaming the streets without their owners. The dogs' owners are the ones who are liable here. You should still go ahead and talk to a lawyer in case any of the people involved come after you.

BTW, don't even apologize to any of these people. An apology could be considered an admission of guilt in court. Don't approach any of them, and don't discuss this matter until it is resolved.

yes. unfortunately u can. even if it wasnt your falt the dogs drank the beer. get a good lawyer. and besides the judge would find u innocent because it was a mistakes. everyone makes mistakes. hope this helped

What if a child had found those pans of beer, drank them, and died? You didn't think about the consequences of your actions.

Not exactly the same facts, but the issue is was it forseeable that leaving out bans of warm beer would result in a man being bit and a car accident.
The idiots who said no or that you had no fault are not attorneys nor do they have any knowledge of the law.

Not only can you be sued by the pet owners, but by the drivers and the city. You created an attractive nusiance which, as you have already been told, created a forseeable ocurrance.

You have at a minimum partial liability in that, regardless of the amount of liability the animal owners must accept for allowing their dogs to roam free, without the alcohol they would not have wandered out into the street.

This would be a very easy civil case to win against you. and yes, I AM an attorney.
