Should I have sued him? Would I have won?

So i got in a bike/car accident yesterday. It was dark out and I was the one riding the bike. I was going pretty fast, and a car comes out ready to pull out (small intersection, no one around). He is blocking the bike lane and the sidewalk (im in the bike lane). I have 2 seconds till i hit him right on. I was calm and took a wide left avoiding the car. I thought i was in the clear until i hear the motor roar and it clipped my back tire pretty badly it was so near my leg. My bike flips along with me and im on the floor kinda in pain. He gets out of the car but doesnt go past it and just yells are you okay. In my mind I'm thinking should i ask for his info and sue his *** (he was rolling in a nice Mercedes too). But then i just said I'm fine and decided not to be a jerk. After i said i was fine he just sped off (i felt that was a jerk move on his part) The only injuries i sustained was scratched leg. The cuts are too deep but very noticeable, and a somewhat swelled spot on my head.

This guy doesn's sound like a jerk. He stopped, asked if you were ok, and you said yes. Not much else you can expect him to do. It was dark, too.

I wouldn't expect you to get anything out of the case. By the time you go to court, you wouldn't have any proof of injury! You'd probably get at most a couple hundred bucks, your lawyer would take some (probably wouldn't even be with the lawyer's time for the case) and you'd have wasted a bunch of tome being a jerk.

Thank you for not clogging our judicial system with stupid cases.

What would this do, this suing? Would you get better much faster than if you didn't not? I am most confused by this, all Americanz wantz to sue everyone. Lawyerz are alway asking you to sue someone. Why?
u should have took down his info regardless. if u were anymore injured he'd have gotten off easy. some people are just jerks, especially rich guys like that. but dont stoop to their level. plus think about the time and the money it would take just to sue him. a guy with a mercedes doesnt seem like he'd go to court unprepaid. you did the right thing. next time just take down some information and be careful.
Technically you are both in violation of the law, and have commited a hit and run.

that goes both to the hitter, and the hitee.
you both left the scene without reporting to the police.

and yes, if you had sued him, you probably would have won.

but you probably should have taken his info, filed an accident report with the police, and consulted a lawyer.

Sue for what? Your medical bills don't sound like they are too bad and you didn't mention any if it cost anything to fix your bike. If you don't have any significant monetary damages then there is little to recover in a lawsuit. Plus, you have the added burden of telling him you were OK and that you will have to assume at least partial responsibility for the accident.

If you really have damages, then file a claim with your insurance company. If you're looking to strike it rich, buy a lottery ticket.
If I were you I wouldn't sue him unless I was injuried badly because its too much drama and plus they probably want evidence. I think you did good!
If you are riding a bike in the dark you better have had a light. cause otherwise the car driver could sue you. and honestly, they would win. remember, that's the space for the cars to drive.
You would have won but only like 100 dollars at most and that would nor cover court fees. If you wernt seriously injured you shouldnt seriously take action. Remember that if you ever get into an accident hopefully not. P.S Stop at an intersection next time even if the stop sign isnt in your direction doesnt mean dont be safe.
did you notify the police of this incident?More importantly,were you wearing a safety helmet and did your bike have lights on it?Unless there were witnesses around,there is no point in suing him as it would be your word against his unless you know there is CCTV cameras in the area and they caught the accident on film.You were very lucky you were'nt severely hurt,my husband was in an accident a few years ago when he was going round a round-a-bout and this dosy cow went straight into him.He ended up with a few cracked ribs,bruised lungs and a severely bruised elbow.We did successfully sue the woman but she was'nt charged by the police for anything.I would go to the police and report this.Good luck.
