Contact the US Department of Labor. You can either write them at: U.S. Department of Labor, 200 Constitution Ave., NW, Washington, DC 20210 ... or you can call them directly at 1-866-4-USA-DOL. Live assistance at their call center is available Monday - Friday, 8:00AM to 8:00PM, Eastern Standard Time. There might not be anything you can do about the criminal background check, but it's best to check with these guys to make sure. It might be a case of your employer going overboard, using bullying tactics, or trying to throw his/her weight around. It seems to me that if this was never mentioned when you were hired, it's not right to arbitrarily add it on to your job requirements. That's just me. The Department of Labor might tell you that it's perfectly legal, or they may tell you that, depending on your situation, it's not. It might be a case of legally right, morally wrong. But I wouldn't let it go; I'd ask them. It's your right to be informed. At least, if you find out that it's legal, you can feel comfortable in knowing that they're not out to get you. Just be careful. If you find out that it's legal, and there is something embarrassing in your consumer and/or criminal background, be upfront with your employer, BEFORE the investigation begins. Personally, I don't feel that how you handle your unpaid debts is anyone's business but your own; therefore, I don't feel that anything negative in that area will affect whether or not you remain on your job, but double-check that with the Department of Labor. A criminal record is another story. If your employer knows beforehand, it might look better for you. Double-check that with the Department of Labor, also.

in MA they do it all the time.I've had like 3 or 4 done on me already and i'm only 22...who cares?
Who cares? It's your privacy man. For christs sake don't GIVE your freedom away. As to answer your question: if you are a paycheck to paycheck (in other words hourly paid) employee then I suspect they can do it. However if you are salaried and have already signed a contract to work for them for so long, they cannot add stipulations to that contract and if they fire you it would be breach of contract (and you could sue them for the amount on the contract, plus legal fees).
YES IT'S LEGAL. iF YOU WANT THE JOB DO IT.IF YOU'RE WORRIED ABOUT YOUR PRIVACY THEN DON'T ACCEPT THE JOB.SIMPLE?
yes it is very legal for them to request it and it is equally legal for them to fire you if you refuse
It's legal because you have a choice.
Comply or quit. No one is forcing you.
Very Legal...Oh, and if you have a MySpace page too, they will check that for "Unbecoming" material...
Derrick...They can if you get promoted, or change to a position where any new hire would be required.
