Situation with a temp agency.?
I was working at a construction company part time as a temp.
THey liked me so much that after a month they hired me on full time. I even quit my other job to take up their offer. Anyway a few days after I started full time, the office manager (who was pretty new herself)was talking crap about another employee to me. she whispered "If you tell anyone what I said..I will get you fired ...and I will kick your ***!" I was really offended and scared that she would get me fired so I waited a few days then told her superior...
Anyway about 2 or 3 weeks after I told on her (and she denied it) they fired me. They gave me no reason or anything. I think it was because of what happened between me and the office manager. and because it is easier to find another me than another her, you know. Can I sue for wrongful termination?I have not worked since. And I quit a perfectly good p/t job for them! btw. i was still on the temp agencies payroll.
Answers:
What state do you work in?
There are generally two types of employment/labor laws depending on the state: "Right to Work" and "Employment at Will"
In a "right to work" state, the employer must give you several stages of "coaching" or disciplinary action, and it all must be documented, before they can terminate you. These coachings must show either negligence, total incompetence, disregard for rules/procedures, or progressive degrees of the same offense.
In an "employment at will" state, an employee is hired with the understanding that their employment is totally voluntary and he/she may be terminated at any time for any or no reason. In other words, they are employed for as long as they wish to be, but at the same time, for as long as the employer allows them to be.
Another thing to consider is your probationary/introductory period. This is usually the first 90 days of employment. During that time, most employers can terminate you for any or no reason, even in a right to work state.
The last thing to consider is: Were you still a full-time employee of the temp service? If so, then the client can end that assignment at any time they choose because you are not their employee and they simply have a business contract for staffing services. If you were still being paid by the temp service, then you have no foundation for a suit against the client, but I would definitely let your agency know what occurred at the client's place of business. It may be too little, too late because you have already left the assignment and it may be seen as a "disgruntled employee" situation. ANYTIME something like that occurs, IMMEDIATELY notify the temp service and bring it to their attention - they can handle it. It may have still resulted in the end of the assignment, but you would not have the same amount of time invested in the job at that point. AND, if you were still a temp, you should never have gone to the management of the client. You must remember who your employer is/was and they were not it, the temp service is/was.
Tell the temp agency - this behavior of that woman was ABSOLUTELY WRONG. All of this is not your fault.
You can try to sue them, but unless you can prove what she told you, the threat and all that, then, I think that it's going to be useless.
probably not, you were on 3 month probation for new job
