I would like to know what the chances are of getting visitation to a grandchild through the court in Canada.

I had a close tie to my grandson, and when my son and his partner parted, she would not allow me to see Josh. She seems to take pleasure from others pain, and even denies Josh's wishes to see, grammie and poppop. My son is still in the 'cycle of abuse' with her even tho they don't share the same roof. She will hurt him and Josh, if he brings Josh to see us. I'm hoping my son will get help to make his own choices, but till then, we want to see our grandson. His mom has been charged with assault on our son, but because he wouldn't give a statement they weren't filed. My grandson was left with her by the police. Josh has 11 rotting teeth, he has been hit, locked in his bedroom and cursed at. He is only 4. My complaints to social services didn't do any good. Well intentioned friends, say 'put up a wall', and move on. I am unable to do that, because I believe as his only grandparents, we can offer him some good times, stability and love, to counteract the abuse and violence he endure

Answers:
I say go for it. You have a great chance. Be prepared to get your son to testify. Do you know anyone else who can report her to social services? Keep the reports going in, but try to get others to do it. School will report they have to, but they need proof or at least suspect. Get him outta there, remember The squeaky wheel gets the oil.
Good luck

It's difficult to say, but it's definitely worth a shot. If you have a good lawyer, I would say you have a fair chance.
