How do I make sure I don't get screwed (more)?
I have been a DUI offender & have a suspended license and am still paying off fines. I was in a car with my friend last night who was too wasted to be driving and he wrecked his BMW. He begged me to say I was driving, because I had only had 2 drinks and he's a felon that would go back to jail for 20yrs. He's from a family of great wealth and swore he'd take care of all my legal fees with personal compensation. my driving record was already heinous- now with a citation that I received last night for driving without a license I may never drive again for a long time, not to mention facing possible jail time and further complications with the legal . I have no way to ensure that he's really going to help me out of this+ make it worth my while. If he doesn't is it too late to back out and say No I wasn't driving? I want him sign a promisory note what should I have as evidence/justification for asking that he compensate me? I want him to pay legal fees and me 100,000 over 50 months.

You are an idiot, (I'm sorry), but I had to speak my mind. LOL, good luck trying to collect from him, now that you have done the deed. He wasn't being honest when he drove the car or asked you to lie, what makes you think he will be honest with you now that you have already taken the fall.
I wouldn't touch that with a ten foot barge pole, man...your friend has to take the rap - they can easily determine who was really driving..you must protect your own crappy record.
I can see why you two are friends - both couldn't fight your way out of a paper bag.
First I cannot believe that you would get into a car with someone who is too wasted to drive, then to even think of lying about who was driving.
I hope they get both of you, put your butts in jail, take away your licenses, and you also GET no money out of it.

Well, I doubt that whatever you make him sign will be legally binding, since it's in return for you doing an illegal act. Even if he signed it, which I doubt, he could very easily turn around and refuse to honor it, which would leave you right where you are right now.
Sorry, but that was really, really dumb to take the fall for this guy, friend or not. At this point, you can TRY to say it really wasn't you, but I doubt that your one witness, homie that made you take the rap in the first place, would back up that story. You need a lawyer.

Well dude, the first thing that you need to do is get a lawyer and change your story to the truth. Chances are that your "friend" will screw you in the end and by the time that you go to court and receive your punishment for driving, it's too late. Then your "friend" will simply back out of the deal and you will be left to rot. You should never have done this, but my question is this: Are you on probation? If so, then you just violated it by driving with no license and by drinking in the first place. On top of that, if you continue to say that you were driving, then guess who gets to pay for the damaged car? Even if he has insurance, the insurance will soon be coming after you. You made a bad move there by even getting into the same car with a drunk.

Just wait till you make your demand for 100g's. Your "friend" or his rich family will file a criminal complaint of blackmail and all of a sudden you'll find your self fighting to avoid a 15 year prison tour.
