If you work a grave-yard shift, do they legally have to pay you for each hour?

I ask, because the shift is 12 hours, but I get time to sleep..I think this is how they get away with not paying me for each hour. I just get a flat rate, with possibe commision. But if I were being paid by the hour, I'd be making much more. Is this right? Or are they breaking labor laws? By the way, I am in Los Angeles, California.

I work as a x-ray tech in Oregon on night shift. Used to be in CA. I think you are being RIPPED OFF big time!! Contact the state labor board and possibly the feds too.

Check with your nearest office of Dept. of Labor - Wage and Hour Division . Ask to speak to an investigator and let them know in full detail what is going on. If you have pay stubs or some record of your hours worked,bring those too.
First, I'm curious, since I've actively worked several graveyard shifts. And I've also worked for commission.

What type of work do you do that they let you sleep on the job?

Is sleeping on the job mandatory?

Or is this some thing you just do?

Is everyone else sleeping?

Are you selling mattress' and beds?

A thought - Perhaps your pay would be more if you were working rather than sleeping, so to bring in that extra kick of commissions.

I'm not sure exactly how California may be, but where I have worked, the min. wage + commission is the way they work it, but they would never tolerate us sleeping on the job.

Maybe that is what the trade off is for you and this company.

Tip -
Go to bed and get some rest at home.
Work while you are at work, working will actively bring up your commission.
Therefore you'd make more money.
