To subpoenea someone, do you have to pay (your lawyer)?

And are the costs the same as in a (regular) lawsuit?

Answers:
Coragrphy is wrong on the issue of subpenea only by an attorney. MANY individuals doing their own legal work, which IS NOT ILLEGAL file subpoeneas all the time, although he is correct on the civil issue. Call your local clerks office or go to its website. Many states have this form online for you to download. And as coragrphy says, although the law can be tricky, a reasonable intelligent person can read and learn them.

You cannot subpoena someone -- only a court can do that.

So, you would first need to file a lawsuit -- and subpoenas are rarely issued in civil cases except against the target of the lawsuit.

You can hire a lawyer to file the suit, or attempt to do it yourself. However, the procedural issues can get quite tricky.
