What is required if an office employee of a medical office doesnt follow the privacy policy?
Answers:
A severe boot up the backside as an absolute minimum. Privacy in a medical office is a serious matter.
If the breach was technical in nature, I suppose a written warning might suffice. If it was a clear breach of medical privacy, then the employee cannot really complain if he/she loses their job.
you fire them
The laws are pretty strict for privacy. If caught they'll end up being fired.
They need to be talked to and explain that if they can't or won't act in a professional manner, that you will have to let them go.
You need to speak to the doctor or dentist and point out that this is both unethical and illegal. I would expect the person to be fired. If you can prove you have been harmed by the release of information you could sue.
Being fired from his/her job; and/or possible criminal/civil prosecution. Also, they will never get a job dealing with medical/patient records
Immediate termination of the employee, disclosure to all persons whose private medical records were violateed, reporting to the medical licensing board, and complete cooperation with said board in rectifying the problem. If this is the only problem, the doctor will probably be placed on probation (by the medical board, not the courts).
On the other hand, the doctor could try to hide it, but if he's caught, then he'll probably lose his license.
