Is this rape?

Last night, I got really drunk and this guy I half know took me into a room and we started making out.
Then he undid his belt and asked me to give him head. I didn't really want to so I started but then tried to come back up again, but he pushed my head down and said that I had to 'finish it off.' bearing in mind he knew fine well I was completely wasted.
Then we left because somebody came in and he started making out with one of my friends...
He's also older (16, when I'm 15.) Does this count as rape, since I didn't ever properly say no, and I could have run away if I'd really tried?

Sounds like it might be attempted rape. It might also be statuatory rape given your age. Drunk at 15 though? The cops will just blow you off. Sorry to be harsh but it sounds like you're hanging around the wrong crowd anyway. To some degree, you're asking to get in trouble with this sort of behavior. You better learn to say NO - Loud and Clear! Or else this will probably happen to you again and next time who knows. Worse of all, you hardly know this guy - how do you know he doesn't have AIDS or something else. I know some girls that had this happen to them - you were lucky - This Time.

It depends on how he did your head. Did he force it or just guide it, b/c there is a difference.
The age of consent, in most states is 16, and since you are younger than that if it's reported to police it is considered statutory rape. At your age you can not legally consent to any sexual activity.

However I doubt given the circumstances of the incident that any AG would take the case to court.
It probably wouldn't fall under Rape, but if you were intoxicated, it would likely fall under Sexual Battery. Being inebriated often causes the court to consider the victim as being unable to consent, which would have made it forceful.

Actually, it's first degree unlawful sexual activity. #1 it's statutory rape because you're underage and you're younger. #2, more importantly, it's forcible because he forced your head back down.

no it isn't rape, although you might get a few bleeding hearts on a jury to agree that it is. it sounds like what you are really a victim of is poor parenting. The next time you decide to start doing adult stuff like drinking and having sex before you are old enough to start doing those kind of things remember to bring along a little adult responsibility with you as well.

Technically, yes. It's statutory rape - and at your age you don't have to give consent - you are deemed unable to consent by proxy.

It is also illegal for you to drink. You were breaking the law. If you decide to report this incident - you will also have to drag everyone involved right along with you. Who supplied the alcohol? Who's house were you in? Where was the supervision? The adults who own the property you were on can be held liable for contributing to the delinquency of a minor.

report it. he was in the wrong. to split hairs it was probably sexual assault, not rape, as the was no vaginal penetration
