Peremptory challenges are unconstitutional if they exclude cognizable groups ( gender, race, ethnicity). Batson v. Kentucky, 476 U.S. 79 (1986). Rhode Island does not allow peremptory challenge in treason, murder, robbery, rape, arson or burglary cases.
