Cant pay bail, how long will he sit?

My friends son was arrested yesterday for shoplifting, not sure what it was, probably cd's or something. He is in his mid 20's and I dont think he has ever shop lifted before, but has gotten into trouble for drugs. She has to come up $400 bail, but is considering letting him sit. How long before they just release him. We are in Georgia.

In most courts he is going to have to appear before the judge.

It will be determined if he can afford an attorney, If not one will most likely be appointed to him by the court. He might be released on his "Own Recognizance" which means he won't have to put up an appearance bond.

If he's been in trouble before the judge may not grant the OR and set a bond amount for him.

Usually at this point someone tries to work through a Bail Bondsman to get him released.

If no one can come up with the bond money he will set in jail until the court if finished with him.


Until his hearing or until the judge grants OR release.

Honestly, let him sit, it might do some good. Mid-twenties is too old to be doing that. He'll get out when he gets a court date or pleads and get his sentence
not a first offense, which means (to the judge at least) a greater likelyhood of a repeat offense should he be released on an insignificant bail bond... if she has to come up with 400 for bail that usually means that there is a 4000 dollar bond, which she will have to pay if he fails to meet any court date or requirement of the court... they will not just release him... they will most likely give him probation and in that case i hope that you will be albe to convince him that the next time he will not be so lucky...
I would let him sit as well. He probably won't be in there long. He has to go to his arraignment and the judge can decide at that time to let the bail stay or release him. On something like this, and depending on how crowded the jails are there, he could just be released and expected to return for his court date.

EDIT: Yes, I have dealt with the justice system and bail can be set before the arraignment. An arraignment will take place so that the defendent can enter a plea of guilty or not guilty. From there it depends on what the plea was as to how the court will proceed.
Most likely 24 hours. They processed him in (which takes forever) and have to check for priors. If he's clean, he'll be processed out, possibly might even see a judge and schedule a hearing.
If she can't raise the bail the judge will rehear a motion to reduce bail. If she still is unable to post it she will remain in jail until trial.
Shop lifting is generally a lesser crime, so he'll only be in jail for a short period of time until a hearing with the judge is set up. Obtaining a lawyer might speed the process up, but that's just unncessary due to the low severity of the crime and the high expense of such a lower end crime.
Tell your friend to hang tough and throw the key away . She is teaching him absolutely nothing to bail him out . He will do it again, believe me . Only a severe slap on the wrist will make him quit that . Most things stolen are of small value , they like the thrill it gives to get something for nothing . He is far too old not to know the consequences .
