Revoke grandparents rights HELP!?
My husband has a child from someone else. He has full custody due to this women being an unfit mother(crack head, prostitution, in and out of jail). I have adopted at the age of 3 which was when she lost custody. my daughter is now 11. my husband went 3 years fighting her for custody but even though the prove is on the table with blink lights the courts would refuse him full custody but anyways he finally got custody due to her mom rating her out. but there was a cost she had to get grandparents rights he agreed BIGGEST mistake! she was just as much trash as her daughter but my husband was desprite. now my daughter is so messed up in the head from this women she no longer wants anything to do with her and we want whats best for her. our fist petition to revoke grandparents rights was denied due to a lawyer who took our moey and ran basicly. i want to when can go to court and have a say if she does not want to have anything to do with them no more. will her opinion matter.

Since your daughter is 11, she is competent to testify. The court will listen to her opinion but it will be just one factor of many. You would need to prove that visitation with her grandmother damages your daughter. This would have to be done by competent evidence from medical professionals. Courts are very reluctant to cut off visitation completely and, even if you prove your case, you may end up with supervised visitation by the grandparents.

TO POISON: YOu have just advised this poster to circumvent the Parental Kidnapping statutes on the Federal Level. I suggest you read the PPKA before ever advising that again.
TO RISSA: The ONLY state which allows a child of any age a legal right to decide is Georgia at age 14 and the issue is NOT relevant here. The grandparent has rights.
And even if the child CAN decide with whom to live in your state, that right does NOT give the child decision power over a valid court order for visitation.
not at 11 no. I think the age is 14 in my state. Check the laws and find out.
