Which agency has the final say as to whether a substance is hazardous or not.?

It depends on the substance. The FDA gets to decide about food and drugs. The Center for Disease Control gets to determine some things, too. It really depends on the substance and which agency governs that genre.
I think that that would be the FDA.

FDA is only for Food and Drugs.
Any substance can be hazardous, however the manufacturers are supposed to take responsibility and place WHMIS symbols on containers.
Hazardous products and/or by-products in the U.S. are governed by the Environmental Protection Agency.
