What legal action could my grandma take? How to go about it?
This lady (Marie) is getting paid by the state to take care of my grandma (she is her home health care provider). They share a checking account and both of their names are on my grandmothers disability checks. Now, Marie is not taking care of her as she is supposed to like she started off doing. She is taking the money from the state that she receives for taking care of my grandma and using it for herself when she hasnt even been taking care of her, when it should go to my grandma to begin with! We are making a police report but is there anything else we can do about this matter?? Is Marie allowed to take that money from the state and spend it on herself???
Answers:
Please contact the Social Security office (they regulate those disability checks) so that they can be alerted to this and hopefully the end result will be that Marie's name is deleted off the checks.
How did her name get on them?
Also, you should contact the bank to see about that joint checking account. It may need to be closed in order for your grandma to take her name off.
There may be some legal issues here. You wont know what though until you begin!
I think you should contact a lawyer...
Contact the state immediately and contact the district attorneys office as well...
Marie is not entitled to be paid for services not rendered. Report this to the government agency that has been sending the check to your grandma. Close the joint checking account where the check is being deposited so that Marie can have no access to your grandma's money. I do not understand why your grandma agreed to open a bank account jointly with Marie. That was not necessary, in my opinion.
You need to talk to someone from the state and get her a new caregiver.
