Who legally owns your medical records?
is it the state, you ,the physician,a lawyer ,or no one? (this is for class)
Answers:
The patient owns the contents on the medical records (whether it is on a digital media or on a piece of paper).
Possession of this record comes with legal responsibility - to ensure that no dissemination is permitted without authorization from the owner of the medical contents.
The hospital, doctors, governments, insurance companies, etc keep the medical information as provided by the patient (or client).
The information cannot be release without written consent by the patient (or client) else there are legal consequences for the release.
Therefore the patient (or client) owns the medical records.
Own by USCIS. lol
It depends on the scenario. If you are applying for disability insurance through the state, then you, the state, the Doctor, and possibly the attorney (if you have authorized it) all can claim ownership of the records. If you are going to a regular Doctor's visit then you and the Doctor both own the records. If you have an insurance company, they own the records as well. If this Doctor's visit is to provide testimony in a law suit the both attorneys will have access to the records . . . Please specify the parameters of your question.
i think it is the doctor, and you. its definitely not the state. but the doctor has to keep the info privite.
You and your doctor are. The state has absolutely no right to them it is actually illegal for them to try to get. if you sign a power of attorney form your attorney has access to them but does not own them
