What to do if layed off while forced to take leave of absence due to auto accident.?
I was recently rear ended by someone and got whip lash. My doctor wanted to limit me from doing any work that required me to lift a lot of weight (my job requires me to lift 65lbs. regularly) or to take 2 to 3 weeks off. I told my employer that I would be able to perform the office duty side of my job but could not perform the manual aspect. On my next day of work I was presented with a leave of absence (I did not ask for the leave) letter stating that I could not come back until I could lift 60lbs. and had been cleared by a doctor. A week later I received an email from my employer informing me that my position was being eliminated and that my employment was terminated due to "lack of business and finical difficulties". I feel that my health played a major role in this decision. The at faults insurance was going to pay for my missed days of work but now I'm not sure how or what I'm entitled to. I need advice on how to handle both the job and insurance aspect of this situation.

You need to speak to your attorney and tell him what has happened and then go and apply for unemployment and you may qualify for temporary disability.
Proving that you lost your job because of the injury is probably impossible since your employer gave you other reasons.
Don't even think about focusing on your settlement and how much you are going to get, focus on regaining your health, the other stuff is why you have the attorney.
