EBAY seller lied to me! HELP!?
I bought 2 paintings on ebay seller from china who has a kinda good feedback.. before i bid, i emailed him tons of times to ask if the canvass are stretched but he never replied! I have no idea why..When its few minutes left and the auction is going to end, I bid and emailed him again, this time on ebay and in his personal email but still he didn't reply..I got frustrated with the simple question he wouldn't answer so I posted 2 neutral feedback on his profile telling him I won't pay him until he answer if the paintings he's selling is stretched already/ready to hang or not but lo and behold! The next day, he posted 2 negative feedback on me telling me in his bad command in english that I bid and don't pay and he can prove to me that he responded, I followed up and asked where is his proof of respond to my simple question but he never replied! So anyway, I keep emailing him on his personal email asking same question and he finally responded saying ''YES'' they are already stretched!
Answers:
Never ever ever, bid on something when you have asked a question and have not received an answer.
Never ever ever use their email address for communicating. Use the Ask Seller A Question for all communication,
Never ever ever use feedback to get a seller's attention if you are having a problem unless you have exhausted all other options.
Go to PayPal, file a SNAD, I am not going to say lie to them, that's your choice.
But keep something in mind, if you do win, more than likely they will tell you that you have to mail it back to the seller at your expense. Make sure you get some sort of tracking, because they won't release the funds to you until the seller gets the items back. If the seller is dishonest and you don't have a tracking number, they can claim they never got it.
Be careful on Ebay, the majority of us sellers are great, but some aren't. That feedback is there for a reason, always read it to ssee if the seller does have any problems. Good luck!
REPORT HIM TO E BAY THEY WILL HELP YOU. IF YOU PAID THROUGH PAY PAL THEY TOO CAN HELP YOU. NEXT TIME DON'T BUY ANYTHING FROM CHINA.
#1 Do not buy from a seller who will not respond to you.
#2 Never leave feedback until you have received your merchandise.
#3 Never buy from a seller with "kinda good feedback".
This seems to be your own fault for not being suspicious of a seller who will not respond. You can report the seller to e-bay, but it looks like you are most likely going to be out your money.
Have the paintings stretched.
Quit buying on E-Bay.
Sue him in China where the contract was made.
Dang, I'm glad you're not my customer. If you're new to eBay, learn the rules. The guy did not deserve the negative feedback from you. I can't say you didn't deserve it back though. You bought the item after he had not answered your question, so you KNEW the product might not have been stretched. YOU KNOWINGLY BOUGHT IT! So, boo-hoo for you.
Ebay clearly states, and so do many sellers state that you ask all questions before bidding on an item. If the person didn't respond to your emails, chances are that your transaction might not run too smoothly and you shouldn't bid on the item. After bidding you are obligated to pay for the item you bid on...it is basically a contract. Also when you wrote to his personal email it could have went into his spam folder, and his responses could have went into your spam folder. You never know. But you were in the wrong for bidding before knowing the info about your item. You will probably have an unpaid item strike under your account. He can leave you negative feedback, after all you didn't pay. You left him neutral feedback, which you can't take back without completing your transaction.
Also before you said you bid on it before he answered you, then you say you bid on it after he answered you...it can't be both..so which one was it...to me it seems like you were in the wrong. File a dispute as item not as described...but the thing is Paypal may not get you your money back, they try and get the seller to refund you, but after you return the merchandise. But always try to resolve with seller first.
You have no grounds unfortunately. As he replied yes AFTER you already bid on them, it doesn't matter that he lied you had already clicked the bid button (and therefore entered contractual agreement). I strongly recommend never dealing with anybody in China. As far as recouping your costs, if you used something such as paypal you can lodge a complain through them, lie through your teeth, and try and recoup some of the costs.
Bottom line: NEVER leave feedback before the other person does. I have feedback to leave for somebody I dealt with almost a month ago and I will not leave feedback until the other person does. Once that person does, you can respond in kind. If you leave feedback first, you have no options.
Try the site below and watch the movie. Hope this helps for the future!
I am sorry you got taken, but you made a few mistakes. You will need to decide: return them and worry about dealing with him again or just keep them, and call it a loss (you did say you liked them). I would keep them.
We have two longstanding ideas here in the US, I'm sure there has to be something similar in Norway:
1. Let the buyer beware - John Marshall US desision in 1817 which allowed for Caveat Emptor in US law.
2. and PT Barnum - there is a sucker born every minute.
sorry and good luck!
