Usually this is determined by the value of what was stolen.
That would be criminal court, and either a felony or a misdemeanor, depending on what you stole and how much it was worth, etc.
shoplifters are considered felonies and they go to district court. where they will either have to pay restitution and are ordered not to go into the place they were caught shoplifting and or jail time...
