Should they go to jail?

Two teen boys were just going around swatting girls on the butts. The teacher eventually saw them and took them to the office, were they thought they were just going to get a referral. They left in handcuffs. Do you think this is fair? And guys admit that you've done this at least once or twice in middle and high school.

Answers:
I kinda agree that jail time is harsh. I think just suspending or expelling them from school would be reasonable. I don't know why everyone thinks that jail is the answer for little offense. I'm not siding with these boys (what they did was 100% wrong), but with all honesty, we got bigger issues to worry about, than boys swatting girls on the butts. Their teenagers, who knows what goes on in their head.

it's political correctness run amok, and unchecked.
Yes I do. Women constantly being treated as objects or possessions is ridiculous! They are TEENS and they should know better.
man i dont know why some guys are pigs and the anwer to your question is yes they should go to jail and the man who rap girls should get their thing chopped off. i'm sorry but i'm just sayin my opioin.
No, but if they get too rambunxious they should be expelled from school.
Maybe as means to "Scare them Straight." They probably just went to a Juvenile Detention Center.
Well they are looking at charges of sexual harrasment but keep in mind they could get them with molestation which is really seriose that means they will be seen as pedifiles for the rest of their lives so no i dont think they should go to jail but some punishment is in order
I've heard of things like this happening to GRADE SCHOOL kids!

I have always taught my boys that they have no business hitting girls, swatting their butts, or any other "man-handling". It is rude, abusive, illegal these days, and just not the behavior of a gentleman or a civilized person.

Of course, same goes for girls (swatting guys or girls, for that matter).
Yea people go to far these days. Here near Boston there are 2 schools that banned tag at recess because it requires kids to touch one another. The world is a sad sad place these days.
The world is getting too crazy, Obama wants to teach 5 year old children about sex. guess what uncle Shawn next time you kiss your daughter if better be a flying kiss.

Common school pranks are treated as sexual crimes, this is a dangerous path we are walking on...
VERY fair, that's assault. And I have never done this in my life. The girls I went to school with were packing half the time, if they weren't their brothers or friends were.
No butt is worth ten years in jail. Better to keep your hands to yourself. True, school administrators overreact all too often. To a certain extent, we have to let kids be kids and teach them by talking to them, not handcuffing them.
I think the gals should get to swat them back as punishment for the boys.
Of course not!
Yep! Women have been treated as objects for the amusement of men for far too long. By not disciplining them we tell them that it's OK to sexually assault women.

If YOU want to be treated that way, join an S&M club. But nobody has the right to treat anyone with that sort of disrespect.
yes, i do think it was fair. i think that if an adult male swatted a adult female in public , the adult female would have grounds to have the mail taken to jail for an assualt/battery because it's technically if you touch someone. why would an female child deserve less respect ?

boys should be taught by high school where the lines are since they are at an age in which our courts can interpret them as being adults and punish them accordingly. the parents job is to prepare them(BOYS and GIRLS) for real life and this means training on what is acceptable and what isn't.
It is fair as it is not acceptable behavior and no as a young man I never slapped anyones butt as again it is rude and by respecting the ladies I get more than the idiots slapping them
Well, they need to spend a little time in jail, not sure how much this is unaccceptable behavior, and if this sends a message out to the others, who are swatting girls on their butts, and those who even think about doing it. This will let them know, that jail time can happen to you. The message needs to get out. Keep your hands, to yourself, if this is the only way to get that message across. I say 'Right on'.
They should be disciplined but not arrested in my opinion. Their discipline should depend on if they have been in trouble before or done this same action before. Their parents should be required to be involved. They should definitely have to apologize to these girls and need to be educated about why this is wrong and what future consequences this could have - i.e. if they do this as adults or at their place of work when they are older.

Expelled from school yes, arrested no.
all the years of parents complaining and sueing schools over issues like this have brought it to this point, put it in the hands of the law.
this issue should never had made it any further than apologizing to the girls and thier parents for thier behavior and weekend in-school suspension for a couple of weeks. take away a kids weekend, now that hurts.
dont give kids rap sheets, teach them why its wrong to swat girls on the butt. we don't pay teachers to be informants for the police, we pay them to teach.
Of course it's fair. Sexual assault is a criminal offense. Why do you think you have the right to physically attack anyone else? Just because you think it's funny?
And, no, I never did this "at least once or twice" in middle and high school. I was raised to have respect for other people and to treat everyone with dignity and kindness.
If you think this was unfair treatment, then what would it take before it becomes criminal: punching with closed fists, physical confinement, or rape?? -RKO- 07/25/07
I can't say I ever did that as a teenager, although when I was in grade school, putting frogs down their back was a popular thing to do.
My initial reaction was no, they shouldn't go to jail, but after thinking about it I think they should (for scared straight purposes). For one, they're teens, they knew exactly what they were doing and knew better. As a woman, I have had my *** slapped and grabbed against my will and it's very discomfitting. It's a loss of power. Why should anyone get to grab my *** when I don't want them to, when it makes me very uncomfortable, and makes me feel powerless?
NO they shouldn't go to jail. That is ridiculous! Yes, they should be disciplined, but jail is not the answer.
Well, I never did that actualy!

As for that other issue, no, they shouldn't go to jail; there are so many things a principal can do before putting some mindles teens together with real criminals!
Hmm. I wonder if any of the girls involved made a complaint. If it is consentual joking I fail to see why they should be in any trouble at all just cause a teacher saw them.

If any of the girls were not ok with it yes, they need to be taught a lesson, as an adult you can't walk around doing that to people you aren't sure will be ok with it. Better they learn their lesson when they are juvies than when they are adults and run the risk of being labeled sexual predators.

They should certainly be arrested and charged, if one of the girls will be a complainant. If convicted, I highly doubt they will see any jail time though, probably some sexist counselling and community service, unless they have a history of it.
THEY NEED TO BE ARRESTED BUT TO GO TO PRISON FOR IT IS ANOTHER STORY.
It is Battery and Sexual Harassment Plain and simple.

I would stronly suggest these 'boys' read the following report:
Hostile Hallways: Bullying, Teasing, and Sexual Harassment in School which can be found here http://www.aauw.org/member_center/public...

Sexual harassment in schools is unwanted and unwelcome behavior of a sexual nature that interferes with the right to receive an equal educational opportunity. It is a form of sex discrimination that is prohibited by Title IX, a Federal law establishing civil rights in education that addresses issues of sex discrimination and, by judicial precedent, sexual harassment.

Sexually harassing behaviors that can interfere with one’s educational opportunity range from words (written and spoken) and gestures to unwanted physical contact. Some of the behaviors may also be criminal acts (assault and rape, attempted or completed and child sexual abuse).

Both the Federal courts and the Office for Civil Rights (OCR) of the United States Department of Education (ED) recognize two forms of unlawful sexual harassment in education. The first form is quid pro quo harassment as defined by the guidance in the "Federal Register," issued on March 13, 1997, by the OCR (ED, 1997).

Quid pro quo harassment occurs when a school employee explicitly or implicitly conditions a student’s participation in an education program or activity or bases an educational decision on the student’s submission to unwelcome sexual advances, requests for sexual favors, or other verbal, nonverbal, or physical conduct of a sexual nature. Quid pro quo harassment is equally unlawful whether the student resists and suffers the threatened harm or submits and thus avoids the threatened harm (ED, 1997).

The second recognized form of sexual harassment in schools is hostile-environment harassment. Hostile-environment harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature by an employee, another student, or a third party.

This form of harassment requires that the harassing behavior be sufficiently severe, persistent, or pervasive so as to limit a student’s ability to participate in or benefit from an educational program or activity, or to create a hostile or abusive educational environment (ED, 1997). Typically, in school settings and particularly between students, allegations of hostile-environment harassment are more commonplace than allegations of quid pro quo harassment.

The school and the district were correct in dealing harshly with the incident in light of the decisions in Davis v. Monroe County Board of Education and Gebser v. Lago Vista Independent School District
Yeah they should wether it was just a slap on the butt or not, it's still a violation of that girl/women. If you rapped her should you go to jail? You would still be violating her. Look at this day and age, women aren't pregnant, barefoot in the kitchen anymore, we are more powerful then that and only getting stronger and men all the way around need to respect that and expand their point of view on women, rather then a piece of "tail".
