Depending on the state you're in, it's possible you may be able to file a small claims suit. Most of the time it's for claims under $5,000, but it can vary state-to-state.
Go down to your court clerk's office and they'll probably have a small claims packet. In small claims, you are not represented by an attorney (it's all in pro per) but you can consult with one, which I recommend.
You go to the court, file your complaint/petition (probably around $50 or so); get a hearing date. Then the defendant must be served personally by someone not a party to the case. Then you file your proof of service with court.
Make sure you have all your documentation, evidence and witnesses lined up.
You can't just fill out a form! You need to talk to a lawyer and then take this to small claims court-where you can represent yourself!
Why don't you have an attorney simply send a demand letter explaining what you want, and what action will be taken if they don't comply with you?
This works most of the time.
Remember: A person who represents himself in court has a fool for a client.
Go to your local court house. They'll walk you through everything.
The BBB is simply a membership and record keeping agency. They do not litigate or arbitrate or anything else. Suing someone is not just a matter of filling out a form, any more than surgery is a matter of buying a scalpel
