Temporary Employee-Never given reason why I was fired?
My fiancee was recently terminated from a Temporary job. Apparently it has been said that the employer does not have to disclose to a temporary employee why they were terminated. My fiancee filed for unemployment and now the former employer is looking into it and the reason given was that my fiancee was "Unreliable and didn't show up to work when he was supposed to." This is a bold-faced lie as I have documented proof done by the former employee that in the 4 months he was working, he completed his 40 hours a week and then had 86.5 hours of documented and reported overtime. He had one day off becuase he had a 104* temperature. It seems as though they are going to fight paying the unemployment. Is there any way that we can counteract the reason given? Is there some law in Florida that says they can't fire you without a reason? Is there a website where I can get information? Can we file a lawsuit against the company for firing for false reasons?

If you have documented evidence that he always showed up and on time, and you also have it in writing that they claimed otherwise, then you can sue for libel. You can get your own lawyer involved, or you can try the Florida Department of Labor. Odds are when they hear the word lawsuit or that the gov't is getting involved, they will probably change their tune.
As a temp you can be fired for any reason or no reason at all.
That's why it's temporary. Sorry, but you're SOL.
If you cannot resolve it through the employer, with a letter, then I would suggest going through the labor board.
a temp agency does not have to give any reason for you being let go... you are a temp only there as a temporary cover for whatever

They can get rid of a temporary employee whenever they want because the employee is (dee di dee) TEMPORARY
Most employers, especially those who hire temp workers, have an "employment at will" clause that allows them to pretty much fire an employee for anything.
Many places look to get rid of temp employees after X amount of time to prevent them from earning full-time employee benefits. Ethical? NO. Moral? NO. Legal? Yes.
Its a mess.
They do not have to give a reason. A temp. can be fired one day and another temp. brought in the next doing the same job.
You're out of luck for losing the job, but as for the filing of unemployment, you can challenge it and get the unemployment payout anyway as long as the office believes your side of the story or they can't prove what they say.
Something sounds a little fishy ... What temporary agency was he working thru? If what you're telling us IS true, the temporary agency would have put up QUITE a bit more of a ruckus considering they get money when people show up for work and if he is pulling that kind of overtime, they would be making QUITE a stink!. there are a buncha websites and places you can go and call and file a complaint ... and by the way, I am originally FROM Fort Lauderdale and KNOW that Florida is a "right to work" state which means, someone can come along and say "I can do what he is doing for "X" amount of dollars less than you're paying him" and they can let you go and give the job to the lower payed person.
