I hired a contractor for 2 of my clients, but he quit before completion and claimed I owed him more money.?
Our contract stated that in the case of unforeseen expenses, the client would immediately notified of unforeseen cost and determine appropriate actions at that time. No one was ever notified, until the end of the job and the work had already been done. He is threatening to sue my business and drag the client and I through the court system if I do not pay him. Also, he USED to be my best friend, obviously not now. How should I approach the situation?
Answers:
Contact and consult an Attorney immediately. Without knowing which state you are in, it would be difficult for me to give you advice as to how to approach the situation. My ex husband and I owned and operated a Construction Company for close to seven years together. We only had one contractor that tried to pull something like that, which we took to court and won based solely on the contract. If he completed the work without notification of the additional costs, then he is going to have to eat the expenses. As a friend, you may offer to split the cost with him to save your friendship. Best of luck to you, I know that is a tough situation.
You have a contract. Enforce it.
If you hired the contractor you alone are responsible for payment. If you have a problem with the situation you're in you should talk to a lawyer.
