My three year old has been fearful of the dark?

his father and I have a split arrangement, and lately he's been saying his dad locks him in the dark by himself. I want to know if the courts take a three year old's statement seriously. I need to change the custody order to full custody, with the father having every other weekend visitation.

Do you think a three year old's statement is valid in front of a judge? My child also cries and shows apprehension when I mention his father.

Answers:
Holly crap Jen what the puck you better be damn sure of what you are saying Jen this could back fire on you something serious with you holding the short end of the stick.. but to answer you yes

yes its good from anyone just tell him his fathers name or talk about him and he will cry 3 year olds don't act under pressure
Usually a judge doesn't take the statements of a child with much weight until they are 12-13 but I do think it would be a good idea to at least get what is happening into the court records. Who knows, maybe the judge will listen to him.
Generally, no they don't. But, it is possible. I suggest you take your 3 year old to see both his pediatrician AND a psychiatrist immediately. Then, go see an attorney.
