How would the parties establish exactly what was agreed to.very confused?

In the event of a dispute involving an oral contract, for less than $500, and that could be completed within one year, how would the parties establish exactly what was agreed to?

Answers:
There would be evidence (inevitably conflicting) about what was said. There may be corroborative evidence, such as how the parties behaved, that tends to make one or the other party's version seem more likely. Ultimately it comes down to who the tribunal of fact believes.


J. Smith will pay J. Doe $499.99 over the course of one year.
That is $41.16 per month.
Electric bills are more than that,and in some places Water Bills are more than that.
Me: "I offer to sell you my pen for fifty cents."
You: "Ok"

Do ya really think we need a writing for us to figure out the terms of this contract. And if we did how would you sign it, I ain't handing over the pen until the contract is formed.

I guess 99%+ of all contracts are either oral or implied.

Get your car washed. Contract,
Get your hair cut. Contract.
Buy a container of milke. Contract.
Hire the neighbors kid to mow the lawn. Contract.
