California Smoking Laws?
I know that it's illegal for minors in California to buy cigarettes.
Is it legal for anyone under 18 to smoke/be in possession of cigarettes though?

Penal Code section 308, subdivision (b), makes it unlawful for anyone under 18 to possess any tobacco, cigarette, etc. It is an infraction punishable by a $75 fine or 30 hours of community service. Note that a $75 fine with applicable assessments will wind up being around $225.
By law, no minor in California should be in possession or using tobacco products.
Pity is, there isn't enough enforcement to stop that law from being enforced practically.
Just wondering. Do you support minors having the privilege to begin slow suicide before their 18th birthday?
I believe it is legal, or our juvenile courts would be bursting at the seams.
By the way did you know that according to the American Cancer Society as reported in Newsweek Mag, the total number of lung cancer diagnosis in the US is only 3%..did you know that? 3%
I have a feeling that it is not actually on the books as a law. That is a very interesting question that you could have answered by calling the police and asking them. That way your information will be absolutely correct.
I can find no place where it indicates directly that it is illegal for them to posses tobacco.
However, I would ask a police officer in the state of CA if there is such a statute and what it is -- tell them you are working on a paper.
As to the person who pointed out that only 3% of the population is diagnosed with lung cancer. -- There are many killers other than lung cancer. My dad died of COPD, my aunt of Emphysema. Don't kid yourself. There are other statistics related to smoking related deaths, and it is now reported on the death certificate if the death was smoking related and how.
No. it is ILLEGAL for minor to be in possession with cigarettes. I know because my 16yr old got a ticket for it and HE paid a darn good fine for it. He wasn't actually smoking at the time he got caught but he did have a pack in his possession. (and yes, he admited they were his to me) Now police officers don't go around looking and ticketing children for it but given the right opportunity and they will and should. It is the same as if a minor is caught drinking or having alcohol in their possession.
