What if a boss doesnt pay the correct amount of overtime?
Ok situation. Where I work if you work over 40 hours a week, then you get paid off the books for overtime. Plus, its not even the correct amount of time and a half, its your regular wage. This cant be legal...is it?

No it's not - in fact, the guy is ripping OFF YOUR SOCIAL SECURITY BENEFITS ... you should go report him there and ask whom else would need to be notified - like Worker's Comp, Unemployment and/or etc.
See - when he rips you off and you get less than time and a half on overtime - he is also making a mint by not paying the above organizations WHICH ACTUALLY STEALS YOUR BENEFITS IN THE EVENT YOU NEED TO CASH IN ON THEM ...your time and money made will be far less than what you may think ...
JUST BECAUSE HE RIPPED YOU OFF - go get him and don't let go ...
If you ask the scum bag - he will probably tell you that you are getting your time and a half BECAUSE THERE IS NO TAXES BEING TAKEN OUT ... another big problem if the IRS finds out ...

No it's not legal to pay "off the book" that tax evasion and violation of wage and labor laws.
it's not legal to be paid off the books. it's your word agaist theirs. not a smart move on your part.

Chances are that it is not legal. There are companies who are not required to pay you for time and a half. Likewise, some companies will pay you, even if you are exempt and they aren't required to pay you.
