How to take someone to civil court?

I am so mad, this woman owes me 440 dollars cause I took care of her things for a while, and she says she will pay me, but she hasn't and won't. She's such an idiot she put my check in someone elses mailbox and refuses to issue a new check to me. I want to take her to court, how do I do it? Will it cost me any money? I hear civil court is free. Please help, i am so p.o'ed right now. Thanks to all non dead beats out there.

Go to your local Small Claims court and ask for a legal advisor to assist you. Most Small Claims courts have laws school students working under an attorney who offer you general legal advise in filing a claim with Small Claims.

Filing fees vary; it may cost $20.00 to file a claim, with a small fee to the court for the clerk serving the Complaint via US Mail on the defendant. Service processors are more costly, but personal service is always preferred when the defendant is a cunning type, and knows not to open certain letters and send them back to sender.

As to the substance of your case, you need to prove by a preponderance of the evidence that the lady owed you money, and you did not receive the money. Did you sign a contract? Any witnesses to the transaction? Did you write to the lady apprising her that you did not receive the check?

go to Court house in your area and get packet for a civil case. it Will cost to have it served if you cant find a friend to serve her.
and i think i remember a fee at the C.H.
for the processing of the papers once filled out.
