I would like to become an emancipated minor?

I am 14 years old and would like to become an emancipated minor when I become 16.

I am unsure whether or not I qualify, so I would like to ask you guys for your opinions. Here are my reasons:

1. My parents are overly controlling
2. My parents are racist
3. I have hated my father since I was 9 years old for various reasons
4. My parents do not care about me at all.If I ever claim to be sick, they say I am "faking".Once I had pneumonia and they did not take me to the hospital until I had not eaten any food for a week and couldn't walk.

I am sick of my parents racist ways and that they restrain me from doing anything to follow my dreams. They treat me like trash and my brother a prince.

I would like to become emancipated and then move in with my friend who lives in Japan. I want to be as far away from these horrible people as possible.

Would a judge see these reasons fit? How can I bring it up privately? I am afraid what my parents will do to me if they find out about it

First, the requirements for emancipation do vary somewhat by state, but it’s rarely granted in any state.

Do I personally think you’re going to convince a judge with that argument? I doubt it. But I’m not the judge.

1) Many kids think their parents are too controlling, but parents have the right and responsibility of controlling their children
2) While racism, in my opinion, is incredible stupid, it’s not necessarily reason for a court to severe parental ties. An exception to that would be something along these lines--if you were adopted and were of a race that they were prejudice against, and they were making constant derogatory comments toward you because of it, which could be considered emotional abuse. But I assume that’s not the situation.
3) Saying “I hate my father” (which is very sad) isn’t going to convince a judge
4) As long as they sought medical treatment before any damage was done, it’s basically irrelevant that they didn’t seek it immediately (unless it required immediate attention). If I took my children to the doctor every time they claimed they were sick, I’d be broke.
5) Restraining you from following your dreams isn’t going to convince a judge either. You can follow them when you turn 18.
6) Saying they ‘treat you like trash and treat your brother like a prince’…well, it just sounds childish and immature. It’s not going to convince a judge.

There is no way to get emancipated without your parents knowing about it. You can probably petition for emancipation without them knowing, but once you petition, they will be notified. They get to show up in court and tell their side of the story.

No judge will emancipate you so that you can move in with a friend. In order to be emancipated you would have to prove that you have a job and you earn enough money to fully support yourself--paying for rent, utilities, food, medical expenses, etc--completely on your own (and while remaining in school). That doesn’t mean moving in with a friend and depending on them for help/assistance.

Also, I don’t know that your emancipation would be recognized in another country. It would be recognized in any state in the US, but another country…I’m just not sure.

Finally, the court can require other things as well and they can deny emancipation for absolutely any reason that they see fit, including, but not limited to, their belief that the minor lacks the maturity to function as an adult.

Now, with all that said, let me just add that I am very impressed with your writing abilities. You know how to spell (and many kids on here don’t), you know how to construct a sentence, and you know how to present an argument (even if I personally don’t think that argument is going to convince a judge). Kudos to you!


To become emancipated, you have to be living on your own and self-supporting, and prove to a judge that you're capable and qualified to live as a legal adult.

Emancipation is not a solution for being unhappy at home. If you truly feel it's a dangerous environment for you, you can petition the court to make you a ward of the state - basically putting yourself in the foster care system.

If you can get your parents' consent, you can live other than at home. They would need to provide power of attorney to the adult acting as guardian for you.
its sounds to me you need to talk to a shrink as you gotb alot of problems how much it is because of the way you are acting I dont know but I do know you need help before you go off the deep end

You will grow up without children, and if somehow some moron marries a HS dropout, then you will have to tell your children that 15 years ago you dropped out

A judge may emancipate u at 16:
Although u can't get a mortgage until 18, nor can you get a credit card
You remain legally a minor, and cannot sign any legal binding contracts
Whoa . . . do you have any grandparents nearby that you can speak to about this? An aunt or uncle perhaps? Consider speaking to a counselor at your school. They can also help you out.
you will need a lawyer and a job and you have to prove that you can support yourself without your parents then you can give the reasons why you want to be emacipated
You'll need your birth certificate, a passport, a secret hidden stash of cash, and the ability to endure two more years of mistreatment past bordering on abuse. Possibly no one will acknowledge you when you ask for help, but do not quit asking. Seek a school counselor referral to a health care provider in your area.
