I have a couple of questions about a threatening message?

I have a .wav file that I recorded from my voice mail box. It was a voice mail that my brother sent me. In this voice mail he said the words "If I ever see your *** again, I'm going to kick your *** black and blue *****. You better believe it." I have evidence against him now. I can turn this in to the cops right? Another thing I want to know is, can he do anything to me because I sent him a text message saying, "I'm sorry I couldn't make it to your son's funeral and I'm sorry your daughter got hit by a car." These things didn't happen, I was just trying to piss him off. Obviously it worked because he called me and started cussing my voice mail box out. If I do turn this into the cops against him, what is the worst thing that can happen to him?

sounds like a juvenile pi$$ing contest and they will treat it as such....and to be honest as you sent the message FIRST what one earth did you expect him to say....

Sounds like you brought it on yourself. I'm sure that his threats against you will be mitigated by the fact that you provoked his angry call.
The first respondent is correct, had you said absolutely nothing to your brother, like you should have, you'd have a case against him.

The worst charge that he could get from that would be assault. More than likely nothing would happen to him. I would say the best thing to do in this situation is to stop making inflammatory remarks to your brother. If you guys can't be adults, then just ignore each other. I wouldn't bother going to the cops, they honestly have better things to do with their time than to settle petty disputes for people that just need to grow up.
Mutual harassment, by the way why are you two fighting? Sounds like someone owes their brother some money, and collection of a debt is not harassment, on the other hand telling a brother you didn't attend his sons funeral sounds like a death threat to the son.
The worst thing that will happen to him is a simple assault charge - a misdemeanor. That's if a jury convicts him (and if the prosecutor brings charges, which is doubtful). After learning of the text message, that conviction is doubtful by a jury. Most people would think you deserved what you got and wouldn't convict your brother for that reason.

You also face assault charges - your comments are typical for those interpreted as threats made against another. You may also face harassment charges, a possible misdemeanor in your state. There's solid evidence of those charges - the text message. Even if it was deleted by your brother, his testimony is equal to yours in court. If he showed it to others, then they can also testify they saw it. Even if he deletes it, it may still exist in the phone company's database.

You said it yourself - you did it to "piss him off. Obviously it worked ..." If your brother is charged, it will be only reluctantly. The prosecutor will look for any way to screw you he can because you're the one who set up your brother. Your set up operated the same way almost all set ups work. The person who does the set up often finds himself in more trouble than the victim.
both of you have engaged in very inappropriate behavior, enough that would inspire people to hate you. Still, neither seems to be criminal. A conditional threat, a threat to inflict harm at some future time, if certain conditions are met (If I ever see you. . .") is not a criminal threat.
