If there is ajoint checking account and the secondary accout holder write a bad check who is held responsible?

secondary is wife and she left with another man still legally married but wrote some of the checks the day she left

Both account owners are equally responsible, but the bank will go after whoever has money and is most accessible. The bank's concern is the money; working out which of you should pay for it is your problem, to their point of view.


Both parties listed on the account are responsible for the amount of the check(s), but the person that wrote the checks, if she knew that there wasn't sufficient funds to cover the checks, could be charged with Deceptive Practices, for writing bad checks, and depending on the total amount, how serious a crime it is.
