If i sue the company, is it legal for them to fire me or prevent me from obtainning a better position?
i work for the Board of Education. i havent gotten paid in about 2 months. im pissed and im going to sue.
my question is, when i sue, can they fire m,e because of it?
and can they prevent me from becoming a teacher i the future?

You need to speak to an employment lawyer and/or a civil litigator. it is against the law to retaliate against an employee because of legal action.

They can't prevent you if they cite that as the reason - but they can find other reasons and use your attitude against you.

I would go to a laywer and ask for legal advice, usually they're required to give advice for free and would be able to tell you if that would be a smart move... I don't think I'd want to sue a company and still work for them...
Well, they can sure make it hard for you but why would you want to work for them when they aren't paying you now?
It is not legal but you should weigh your other options first. For what reason have they not paid you?
They can't fire you for taking legal action. If they do, you can take legal action against that as well.

rightfully so though, if you are mad enough to sue them for something then you shouldn't be working there.
they would probably make your life miserable. every little thing you done wrong would go on record and if they can they will give you slips or whatever they do to say look if you get anther one of these you will be fired. If you do not have a union i would be very careful after you sue them. They will find ways that are legal to make your life miserable. I would just leave and go antor board of education if you can. I would try to ask why you have not been paid in two months tell them if you do you not get your money you will have to get a lawyer involved.
I am not trying to scare you i mean you do deserve your money. I am just saying companies do not like being sured.
Have you tried all of the other avenues available? Have they explained why you haven't received your paychecks? Have you talked to the payroll department or their superiors? A lawsuit can create hard feelings and it's best to avoid it if there's any other way to get your pay, especially if you plan to continue working there.
If you're really angry enough to sue, maybe you need to ask yourself if you really want to continue working there.
Off the record, that would be a good reason for them to terminate you but think about it. Would you really want to stay if you sue them and win? They could put your through hell until you quit.
Whenever an employee sues an employer, either for discrimination or in your case back pay, the employer is not supposed to terminate the employee. In reality it is done everyday. Your attorney would then add a charge of retaliation to the complaint.
Employment law is not like criminal law, we do not have restraining orders that can force an employer to keep someone employed.
As for your employer preventing you from becoming a teacher in the future, depending on your state laws, this employer may be able to give you a negative reference.
