Is it illegal to take pictures of people at a public place like the beach?

is was this man at the beach taking pictures of females at southbeach and a guy that saw what was going on told him to stop taking pics of people or he was going to report him to the police, so it left me wondering.

It's not illegal to take pictures on the beach. However, if he tries to sell the pictures without getting permission from the people in the photographs, then he can be sued for damages.

but as soon as you step out of the house, you're pretty much fair game. Not only is it unreasonable to expect that level of privacy in public, it could potentially pose a security risk.

However, if this guy were to publish those pictures and attempt to make money off of them, that's another story!
As long as the pics are being taken where the person would normally be looking (i.e. upskirts are illegal in most states) and in a public location (i.e. not a rest room). Not sure about malls. Assuming that is illegal since it is private property.

No, but it is rude... If someone wants to take a picture of somebody specifically in public they should probably ask them if it is OK first. If you are just taking picture of the background and you happen to catch people in it, that's OK... I think it is only illegal if you publish the pics, sell them, or show them to a public audience without the people's permission.
No it's not illegal. Furthermore, if girls go to South beach (especially if they decide to go topless) they are extremely naive to NOT expect to get a lot of attention!

you can't, however, sell a picture of someone without their permission. you can't make money from it, and you can't distribute it for free if the website makes money (like from banner ads).

I've been told by law officers that if it's in public, you can take a picture of it. With that in mind, it could still be seen as suspicious behavior and subject to question. Recently they jailed a man taking pictures of little girls. Upon questioning, the found that the guy was a pedophile.
You can take pictures of people for your personal use, but you cannot profit off of their "likeness," without opening yourself to a potential civil suit for an accounting and divestment of your profits.

When you are in public it is legal to take pictures, people or otherwise. There is no privacy code in public places....
I heard about this situation and he was told to stop or be arrested for public disturbance. I think there is a privacy issue too, but I'm not a lawyer to figure out what the issue is as it is in a public place. Also the angles of the pictures were clearly suggestive, if you know what I mean.
