Car Accident going to court?

A couple weeks ago I was driving and there was a lot of traffic and I had to brake quickly. I don't know if the car in front of me broke quickly for the light red light and that is why I had to brake, or what. Anyways, the girl in back of me hit my car. A police officer was at the intersection and he saw her hit me so she was determined at fault. A couple days ago I recieved a court summons saying that I am a witness. What does this mean? Are they going to blame me for the accident? She was upset that she was getting points, could she be trying to get out of the ticket an the points?

She was charged with a moving violation and you are being required to appear to simply tell what happened. You would have gotten a ticket if you had done something wrong. You didn't, but you can help the state prove she did something wrong. Simply go and tell the truth. She may try and get out of it, but when someone rearends you, they are at fault for following too closely. Generally, in traffic court, a judge will read the police report, ask the witness or witnesses (you) what happened and allow the defendant (her) to tell her side. Then the judge will make a ruling and hand out a sentence - probably a fine and points in this case and that will be that unless she has a lot of previous issues, then she could wind up with a heftier fine, suspended license, etc.


No, if you are a witness, you are not being blamed. You were just there and they want to hear what happened from your point of view. Its awfuly hard to get out of a ticket, and I doublt she'd try. No worries, just tell the court what happened as far as you know, and try not to say too many "Um..."s or "er..."s.

A witness just means you saw the accident. If she rear-ended you, it's her fault. She wasn't paying attention, or was following too close. You should be fine, best wishes!
i guess she wants to appeal her case and does not want to get points...so the court has asked you being the witness to say that she was at fault...don't worry you wont be blamed for anything...
If they found the car behind you it probably means she is fighting the charges and doesn't want to pay. All you have to do is go to court and tell your side of the accident and they will more than likely rule in your favor. If you don't show up they will take her word because you failed to come so you should go and tell your side of what happen.
