What exactly happens when a father signs over his rights to a child? Please help!? *edited*?
I've heard that if you're on state aid...that its still possible to make the dad pay child support, but I'm not sure. I have NO idea how this works. I just know the dad wants to sign over his rights; because his new gf who he got pregnant's family won't accept him into the family if he already has a kid. (Maybe she should have thought of that before getting pregnant and dating him but oh well.) Ok, and just so people know lol. He told me he was going to sign over his rights. I didn't ask him to. I don't want his girlfriend around my child because she has a MAJOR hostility towards me, and the fact that I'm pregnant, and shes threatened me, so I was going to work out a visitation plan where he could come see the baby supervised. But since his new gf's family won't accept him, and thinks I'm a horrible person for not wanting my child left alone with his gf...he just wants to sign over his rights. Some people are saying he would have to pay still and some say he wouldn't I'M CONFUSED!

Go back and read my reply to your OTHER post. I am an attorney in family and children issues who has worked for the Hague and am licensed in 6 states.
As I told you, the state will petition for support and a finding of paternity upon the live birth of your child. Once paternity is established, he will have the same rights as you do. That includes custody and visitation wihtout interference from you.
You have no rights to tell the child's father with whom he can be in any capacity, with or without HIS child in residence. Unless you can show the court that his current girlfriend is a danger to the child, he gets to select with whom he leaves HIS child.
As to the signing over his rights, I've already answered that question.
You need a lawyer. Your child has the right to be supported by two parents. When your child's father dies, he has the right to recieve benefits. The right to health insurance, etc etc. If you let him give up all claims to the baby, then you will get none of those things. Do not make a rash decision. He should be responsible. Talk to a lawyer and get some advice. Most have free initial consultations. It truly is a matter of life and death.
If you receive public assistance a judge will allow him to sign off on his parental rights but will not allow him to stop paying child support. His rights to the child would be gone but the responsibility for the childs welfare would not.
