Is this fraud??

A while back I get a notice stating that my extended warranty on my car is about to expire. IMPORTANT WARRANTY NOTIFICATION ENCLOSED got my attention.

I called the 800 number and was told their agent that I can extend my current warranty another 10 years and 100 thousand more miles. I ended up making a 175 dollar down payment electronically that day so I wouldn't have to pay any interest on the remaining payments which were to be spread out over the next 18 months. Total cost of the plan was to be 1,800 dollars

In the mail along with the official contract came a bottle of Dura Lube. After reading the fine print I find out their coverage is so limited and the requirements to make a claim are so defined collecting anything would be impossible.

I called and canceled, that was about 6 weeks ago. I haven't gotten my deposit back and they're still trying to collect on the payments. Does this constitute a fraud? I never was told it was a promotion for Dura Lube by their agent. Didn’t find out until their documentation came in the mail.

That most certainly is fraud! Bait and switch comes to mind.

Since you made the payment electronically, call your bank and file a debit card dispute. They will get you your money back.

Legally, probably not. Ethically and morally, I would say so. However, regardless of that, the fact that you cancelled the policy and they have not refunded your money and are still trying to collect is a legal issue, and you should probably take it to a lawyer, or at least threaten to and see if that helps. Document, document, document every phone conversation, who you talked to, the date, time, and what they said and what you said.
