If a child committed a crime, do they get taken away from his/her parents?
A report was made to have on record that the child can be dangerous, the officer in turn stated that he would have to press charges for 2nd degree assault. I want to know would they take the child out of the home based on what they were told or for other unknown reasons.
Answers:
It would be decided in court.
What's the home scene like?
Is he a threat to society?
How old is the kid?
Do the courts have enough resources to place the kid?
Does he have support from family?
well there is a chance he could go to juvie for year tops
They get put in a Juvenile Corrections Facility (formerly referred to as J.D. Hall -- Juvenile Delinquent Hall)
.
It depends on the severity of the crimes the child's being charged with.I dont believe that 2ND degree assult warrents any jail time, depending on child's history with the police, any current parole orders or good behavior bonds would increase chances of a child serving a sentence.
the decision rests with the judge and factors that will influence that decision will be the severity of the crime, kids behavior, attitude, past offenses, his parents and if/how they say they can control him at home. if they say they cannot, they can file out of parental control and remove him OR the judge may order him into foster care if the problems stem from home issues OR he can just send the kid to juvenile lock up or treatment facitlity based on the offense.
