How long do you have to prosecute someone for a hot check?
Answer:
depends on your statue of limitations, If you receive a check that is bad, notify the person by certified mail. Do not have to on a closed account, just insuffient funds. After the deadline you set for the check to be picked up usually 10-30 days turn if over for prosecution. Once it has been turned over, and a warrant has been issued it will stay in the system for seven years for most agencies before they are pulled.
Statute of limitations in most places is two years but you need to check with someone in your area to see what the law is there (except murder which has no limit for prosecution). Contact a detective in the Check Sq at your PD and let them guide you. They may even help you prosecute.
I'm not a lawyer and I'm not totally sure about any statute of limitations on something like this but generally speaking a check is worthless after 6 mos in most cases but you might want to check with the bank the check is drafted from, their legal depts. can advise you on this.
