I was fired for being lesbian in 2000, can i sue the company now knowing the law has changed?

generally you can only sue if the offense was illegal at the time it took place.

if it was legal at that time, and subsequently the law changed, it wasn't an offense at the time it took place. therefore, it can't be actionable, from that time, however, any future acts would be actionable.

Hang on. Was it legal to dismiss you for being a lesbian in 2000? I'd try it - you never know.
was this one of those firings where you were fired, and it must be because you were a lesbian because you want to play the victim, or did they let you know that is why you are being fired?
If u r in the UK...probably...but most actions have deadlines...the longest which is for personal injury is 6 years.however...discriminat... does not have deadlines in employment tribunials.but i still think 7 years would be too long

also if you live in a right to work state they can pretty much fire you for looking funny so it won't matter in a right to work state so much though sometimes you can get through a loop hole.
look into the statute of limitations, but only if the law was the same then as it is now. you cant go back and arrest someone that did something legally at the time even if its illegal now. Also, statute of limitations does vary from state to state so make sure you find information from the state where you were fired.

well if it was illegal then at your job to be a lesbian.. then i don't think you could.. but if it wasn't you def. could.. because that's descrimination and so wrong no matter where you work.. if that's how it is.. you def. should take action b/c you have proof!! that's just terrible..

No if the law changed after you were fired !!
It depends on what state you live in... Florida would make it real hard on you... so would any other state a "Bush" has lived in...

They have "hire at will" or "right to work" policies (funny how those names work) that they like to pretend override the civil liberties that your country guarantees you.

In short, they would try to make you PROVE that you were fired for being a lesbian... rather than try to make the company prove otherwise.
Even though the law in the UK has changed it is a well etsblished fact that UK law is not "restrospective" - this is it does not go backwards. So, any change in the law for example in 2007 would not affect events in 2000.

There are 2 exceptions which are usually quoted:

Lord advocate v Burmah Oil (1965)

DPP v Shaw

If you are saying you were sacked purely on your sexuality this would need to be proven. You would need evidence. If you take the company to court, unless other proof exists, they could merely state it was for other reasons.

If you were sacked [unfairly dismissed is the PC term] for being a lesbian before any legislation was introduced which forbids such a sacking, then I think you may not have a case.

The best advice is to go to your Citizens Advice Bureau [CAB] and ask them about it. Bring all the necessary documents concerning your sacking/dismissal.

You might also try and contact people still working in the office when you were sacked and see if they can come forward with any witness help etc.
You certainly can. It is illegal to discriminate on grounds of sexuality and preferences. Get a good solicitor - your old firm have no grounds.
YES! if you did not let your sexuality interupt in your occupation, you can. that is discrimination towards your sexuality.
the thing is, unless you have proof (witness), or the company has a reputation for doing this, the company will not admit to dismissing you for being a lesbian.
I'm afraid not. The law is not retrospective. Which means that today's laws don't cover yesterday's actions. I wish I'd finished my A level.
