What are the steps to getting a court order for someones belongings after they have commited suicide?

My brother commited suicide and his landlord will not alow my mother and I to get his stuff out of the apartment with out a court order. Why would we need one and how do we get one? I thought his belongings went to next of kin. This is in NY state. Please help me I only have 22 days left. Thank you

because anyone can go into someones apartment and get what ever they want and that is against the law. u will need to go to the court house and prove u are his family by his birth certificate and have his death certificate ready. cause u will need to show that to the county clerk . u will have to get a court order for possession of his belongings and your brother may have owed back rent it is possible u may have to pay that in order to get all your brothers stuff. be prepared as u may have to go infront of a judge with all the paper work showing u are truly family to your deceased brother. this could take 2 days or it could take 6 weeks but either way the land lord cant get rid of his stuff or sell his stuff . so dont worry about that. tell them it is a emergency to get his stuff out and your landlord cant get rid of the stuff when u show him u are proceeding to get a court order like he requested. i am sorry for your loss and god bless u and your family...
