If a product is made in Korea or Japan, may I make the same idea but in America?

Please do not just tell me to get a lawyer or look in a patents office. This is obviously what freelawanswer.com is for.

Articles imported to the US are no doubt patented in the US.
Therefore, one in the US cannot produce and sell the same item in the US.

If a product is not patented in a specific country, that product can be produced in that country and sold there. It cannot be sold in any country where it has been patented.

In order to protect rights worldwide, a product must be patented in all countries. A very expensive process.

No country is obligated to recognize a sole patent in another country.

If the product in question is not patented in the US, the answer is "Yes", you can produce and sell here.
You must research the patent rights of the product in US, or risk a very costly law suit.

Yahoo cannot answer a question of patents. That takes a great deal of research for every single product. An attorney charges about $7,000.00 to do this in several countries.

One can do some research on the internet, but may not find all products or patents there.


Only if you get a license to manufacture it from the company that holds the patent rights, otherwise you will be sued.
hate to dissapoint you, but only if you don't break any copyright or patents.
Odds are the parent company that is selling the item has the patents in America they just have it produced overseas, so the chances of you being able to aren't very good unless you don't mind a few lawsuits.
In business,or wherever money is to be made, if it is possible

to steal an idea, they usually do.
